In this case between a German company and a Belgian consumer, the Court confirmed that Belgian consumer law continues to apply despite contrary provisions in the general terms and conditions of the trading platform.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-kernpunten-van-de-zaak-herroepingsrecht-en-reserveringskosten\">Key points of the case: right of withdrawal and reservation fees<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The case revolved around a tractor that a Belgian consumer had purchased for \u20ac415,000 through the online platform technikboerse.com. The consumer paid \u20ac20,000 to the German company, after which the company considered this amount to be a \"reservation price.\" When the consumer exercised his right of withdrawal within the legal deadline, the company refused to refund this \u20ac20,000.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-juridische-vragen-over-internationale-online-aankopen\">Legal questions about international online purchases<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Court answered four crucial questions for e-commerce across national borders:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Which court has jurisdiction?<\/strong> Can a forum selection clause force Belgian consumers to go to a foreign court?<\/li>\n\n\n\n<li><strong>Which law applies?<\/strong> Does Belgian or foreign law apply to online purchases?<\/li>\n\n\n\n<li><strong>What is a remote sale?<\/strong> When is an online purchase with the right of withdrawal?<\/li>\n\n\n\n<li><strong>Are reservation fees allowed?<\/strong> Can web shops charge fees for withdrawal?<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-rechtsmacht-blijft-in-belgie-bij-internationale-webshops\">Jurisdiction remains in Belgium for international webshops<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court ruled that the Belgian courts retained jurisdiction despite the Munich forum selection clause in the general terms and conditions. According to the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/NL\/ALL\/?uri=celex:32012R1215\" target=\"_blank\" rel=\"noreferrer noopener\">Brussels Ibis Regulation<\/a> (Articles 17-19):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A consumer can be sued only in courts in his own country<\/li>\n\n\n\n<li>A seller directing its activities to the Belgian market accepts the jurisdiction of Belgian courts<\/li>\n\n\n\n<li>Forum selection clauses in general terms and conditions cannot erode consumer rights<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-belgisch-consumentenrecht-van-toepassing\">Belgian consumer law applicable<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Court confirmed that Belgian law continued to apply, despite the choice of German law in the terms and conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/NL\/TXT\/?uri=CELEX%3A32008R0593\">Rome I Regulation<\/a> (Article 6) protects consumers by applying the law of their domicile<\/li>\n\n\n\n<li>A foreign webshop targeting Belgian consumers must respect Belgian consumer law<\/li>\n\n\n\n<li>Choice of law clauses cannot circumvent protection of local consumer laws<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-herroepingsrecht-bij-online-aankopen-blijft-overeind\">Right of withdrawal for online purchases remains intact<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A key finding was that this was a distance sale with full right of withdrawal:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Even though the consumer had viewed the tractor beforehand, the contract itself was concluded remotely (via e-mail)<\/li>\n\n\n\n<li>As a consumer, the buyer was entitled to a <a href=\"https:\/\/economie.fgov.be\/nl\/themas\/verkoop\/reglementering\/herroepingstermijnen\/herroepingsrecht-bij-aankoop\" target=\"_blank\" rel=\"noreferrer noopener\">withdrawal period of 14 calendar days<\/a> (art. VI.47 <a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi_loi\/change_lg.pl?language=nl&amp;la=N&amp;cn=2013022819&amp;table_name=wet\">Code of Economic Law<\/a>)<\/li>\n\n\n\n<li>This right of withdrawal was timely and properly exercised by the consumer<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-geen-reserveringskosten-bij-herroeping-toegestaan\">No reservation fee on withdrawal allowed<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Court rejected the concept of \"reservation fee\" as a non-refundable cost:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A unilateral statement on an invoice does not create a binding contract<\/li>\n\n\n\n<li>There was no evidence of a separate agreement on these costs<\/li>\n\n\n\n<li>Such provisions would violate the statutory right of withdrawal (Art. VI.63 WER)<\/li>\n\n\n\n<li>Upon revocation, the consumer does not owe any costs unless specifically provided for by law<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-wat-betekent-dit-voor-online-shoppers-en-webshops\">What does this mean for online shoppers and web shops?<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-voor-consumenten\">For consumers<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As a Belgian consumer, you are better protected than you may have thought:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You can start proceedings against foreign webshops before Belgian courts<\/li>\n\n\n\n<li>Belgian consumer law protects you when buying from foreign online sellers<\/li>\n\n\n\n<li>Your 14-day right of withdrawal remains guaranteed regardless of what the terms and conditions say<\/li>\n\n\n\n<li>Reservation fees, cancellation fees or other additional charges on withdrawal are unlawful<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-voor-ondernemingen\">For enterprises<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If you operate a web shop that sells to Belgian consumers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Know that Belgian consumers can sue you in Belgian courts<\/li>\n\n\n\n<li>Belgian consumer law applies even if your terms and conditions state otherwise<\/li>\n\n\n\n<li>You cannot charge a reservation fee or other fees for withdrawal<\/li>\n\n\n\n<li>Your general terms and conditions must comply with Belgian law<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-juridisch-advies-nodig-over-e-commerce-en-consumentenrecht\">Need legal advice on e-commerce and consumer law?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Do you have questions about your rights when purchasing online?
