On September 3, 2026, the Court of Justice ruled that a short Facebook post can be a copyright-protected work, and that Directive 2001/29 allows a member state to limit the news reporting exception to short excerpts. A ban on deriving any commercial benefit from such reproduction, however, goes too far. The case involved a Romanian teacher whose 22-line post about gifts at the start of the school year appeared verbatim in an online newspaper (ECJ, September 3, 2026, C-598/24).

In short:

A text posted on a social network is a copyrighted work as soon as it reflects the author’s free and creative choices; its length, place of publication, and genre are irrelevant in this regard.

A Member State may limit the exception for reporting on current events to short excerpts, except when a text is so short that excerpts are not possible.

A Member State may not prohibit the press from deriving indirect commercial benefit from such reporting, because that would render the exception inapplicable to any newspaper.

The facts

On September 8, 2021, a teacher posted a 22-line text on her Facebook page titled “Guidelines for Parents at the Start of the School Year.” In a humorous and educational tone, she let her students’ parents know that she did not want to receive any gifts.

Six days later, on September 14, 2021, a journalist published an article about that message on the website of the Romanian online newspaper Gândul. The headline was followed by the teacher’s message in its entirety. She had not given permission for this. Her name and a hyperlink to the original post were added only afterward.

The teacher sought compensation for her material and emotional damages. The Bucharest Court of First Instance dismissed the claim on April 26, 2022, ruling that the text was not eligible for copyright protection. The Bucharest Court of Appeals upheld that ruling on May 3, 2023. The Romanian Court of Cassation subsequently referred two questions to the Court of Justice for a preliminary ruling: Is such a text a work, and may Romanian law limit the news exception to short excerpts without commercial benefit?

That second question deserves a brief explanation. The Romanian Copyright Law allows the use of short excerpts from works in news reporting on current events, but only without any direct or indirect commercial or economic benefit. Neither of these restrictions is included in the European directive.

The ruling

Copyright Protection of the Facebook Post as a Work

A work, as defined by European copyright law, is an object that is original—in the sense that it constitutes the author’s own intellectual creation—and that is the expression of that creation. The Court of Justice reiterates this established two-part test from its judgments Infopaq (ECJ, July 16, 2009, C-5/08), Levola Hengelo (ECJ, November 13, 2018, C-310/17) and Cofemel (ECJ, September 12, 2019, C-683/17). A text is original when it reflects the author’s personality through free and creative choices.

The Court also points out that the Berne Convention expressly includes “other writings” among literary works. A text posted on a social network in which someone expresses an opinion about inappropriate social practices can therefore constitute a work. The length of the text, the fact that it was published online, and whether it belongs to a literary genre are irrelevant. These factors only become relevant when rules, technical considerations, or restrictions no longer allow the author creative freedom.

The national court must determine whether the author was able to make free and creative choices while writing, as evidenced by the choice, arrangement, and combination of words. The Court adds a noteworthy statement: based on the information provided by the referring court, it appears that the teacher did indeed make such choices, and that they are embodied in a sufficiently precise and objectively identifiable work. The final decision rests with the Romanian court, but the direction is clear.

The exception for reporting on current events: short excerpts and commercial benefit

Article 5, paragraph 3, (c) of the directive 2001/29 allows Member States to limit the right of reproduction and the right of communication to the public for the use of works in the reporting of current events, to the extent that this is justified from an informational standpoint and the source, including the author’s name, is indicated, unless this proves impossible. This is known as the “news exception.”.

The Court first examines whether a teacher’s post about gifts constitutes a current event. According to the ruling, a current event is Spiegel Online (ECJ, July 29, 2019, C-516/17) an event about which the public has an interest in being informed at the time of reporting. The functioning of the school system can be such a subject, the Court ruled. The referring court had reservations because the newspaper had not invited its readers to respond. The Court dismissed that argument: reporting does not require an in-depth analysis, nor does it require an invitation to debate.

The Court then reiterates the four limits on the Member States’ discretion set forth in the Spiegel Online and Funke Medien (ECJ, July 29, 2019, C-469/17). The exception is not fully harmonized, so Member States have considerable discretion. In doing so, however, they must comply with the conditions of the directive and the principle of proportionality, preserve the useful effect of the exception, comply with the three-step test set forth in Article 5(5), and maintain a proper balance between the intellectual property rights under Article 17 and the freedom of expression under Article 11 of the Charter of Fundamental Rights of the European Union. The three-step test requires that an exception apply only in special cases, not affect the normal exploitation of the work, and not unreasonably prejudice the legitimate interests of the rights holder.

Regarding the limitation to short excerpts, the Court ruled that the directive does not specify a formal length limit, but does require that the use not exceed what is justified by the informational purpose. Freedom of the press does not require the publication of a complete work in all cases. According to the Court, a complete reproduction takes the place of the original communication of the work and deprives the reader of any reason to consult the original. It therefore undermines the normal exploitation of the work. A Member State may therefore limit the exception to short excerpts, provided that such a limitation is proportionate and preserves the useful effect of the exception. The Court identifies one exception: a very short text where the use of excerpts proves impossible.

The prohibition on any direct or indirect commercial or economic benefit, on the other hand, does not hold up. It finds no support in the text of the directive, because the words “to the extent justified from an informational standpoint” refer solely to the scope of the use. Media outlets inform the public, but in doing so almost always engage in an economic activity. Prohibiting them from receiving any indirect benefit renders the exception impractical and upsets the balance between fundamental rights. Article 5(3)(c) therefore precludes such a broadly worded prohibition.

Legal analysis and interpretation

The report itself is the news: why that argument isn't enough after all

The newspaper put up a strong defense. The news wasn’t that a teacher found something, but how she put it: the humor and the tone made the story go viral. Anyone who writes about such a post without showing it is, in fact, reporting on nothing. In the Spiegel Online ruling, the Court had already accepted that an exception may apply when the publication of the work itself is the event, and here that argument seems even stronger.

The Court and the Advocate General considered that defense and rejected it. The exception protects the right to report on an event, not the right to distribute the work itself. When the reader finds the full text in the newspaper, he no longer needs to visit the author’s Facebook page, and it is precisely this shift that the Court considers an infringement of normal exploitation. The Advocate General adds a practical argument: on the internet, a hyperlink to the original can give the reader full access without the work being reproduced, as the Court has held since the judgment Svensson (ECJ, February 13, 2014, C-466/12) accepts.

That hyperlink argument has a weakness that exposes the opinion itself. At the time the Advocate General wrote his opinion, the text was still available on Gândul’s website and on at least two other sites, even though the hyperlink to the original no longer worked. A link thus gives the author control over their work, but offers the reader no assurance that the original is still available. The Court’s ruling is nonetheless consistent: those who wish to display the work in its entirety must seek permission, and those who do not must quote and provide a link.

What the ruling means for Article XI.190 of the Economic Law Code

The Belgian news exception is set forth in Article XI.190, 1° of the Code of Economic Law (WER). It permits the reproduction and communication to the public, for informational purposes, of short excerpts from works or of entire works of graphic or visual art in a report on current events. The use must be justified for informational purposes, and the source and the author’s name must be cited, unless this proves impossible.

The Belgian legislature has thus made the same choice as the Romanian legislature regarding the first part, but not regarding the second. This ruling has confirmed that the restriction to short excerpts is a permissible interpretation of the directive. Article XI.190, 1° of the WER does not include a prohibition on commercial gain, so Belgian newsrooms have nothing to fear in that regard.

However, the Belgian court must interpret the Court’s reservation regarding very short texts as part of the statutory text: a tweet or a three-sentence message from which no excerpt is possible must be reproducible in its entirety when the informational purpose so requires. The exception for complete works of visual art shows that the legislature was already familiar with this logic. The Court does not specify where the line is drawn. Advocate General Szpunar had stated in his Conclusion of December 18, 2025 It was proposed that such works be considered excerpts, but only when reproducing the entire work is necessary for informational purposes. The ruling leaves open whether a 22-line text falls under this category; this is precisely the question on which the Romanian dispute will now hinge, and the question that a Belgian editorial team must ask itself with every viral post.

A second issue remains unresolved. In the Romanian case, the author’s name and the link to the source were added only after the fact. Neither the directive nor Article XI.190 of the WER specifies whether a source citation provided only after publication satisfies the requirement. The Court does not rule on this matter. For a Belgian editorial team, it is safer to cite the source at the time of the initial publication; a subsequent correction does not remedy the infringement that occurred in the first few days.

Why the Court itself has already stated that the mail deserves protection

Two Romanian judges had compared the teacher’s post with other, similar texts and concluded that it was not distinctive enough. The referral decision thus primarily provided the Court of Justice with reasons why the text would not constitute a work. Nevertheless, the Court states in paragraph 27 that, based on that same information, the teacher appears to have made free and creative choices that have been fixed in a sufficiently precise and objectively identifiable form. The caveat that the national court must decide the matter remains, but the direction of the answer is also clear.

That is not the Court’s usual practice; it normally leaves the assessment of the facts entirely to the national court. However, this is the second time in six months. In the judgment Călinescu (ECJ, March 19, 2026, C-649/23) the Court had already ruled that the critical publication of a historical manuscript “appears to meet the originality criterion,” again subject to national verification; we discussed that judgment in our blog about the critical edition. Moreover, both cases originated from the same Romanian court of cassation. The Court has thus referred to the same court twice in a row, going further than its own Advocate General, who had explicitly stated in this case that the assessment is factual in nature and falls within the jurisdiction of the trial court.

The substantive correction lies in the standard applied by the Romanian courts. Anyone who judges a text based on what others have written on the same subject is applying a “novelty” or “banality” test. Since the Cofemel ruling, that is no longer the issue: a work must reflect the author’s personality through their own choices, not by distancing itself from what already exists. The fact that hundreds of teachers say something similar every year about gifts says something about the subject and nothing about the way this teacher phrased it.

Belgian case law has addressed the same issue. On March 24, 2023, the Court of Cassation ruled that a lawyer’s writings could not be excluded as a category and required an assessment on a case-by-case basis. On January 17, 2024, the Antwerp Court of Appeals applied the same reasoning to a nature photograph of a deer: the defense—arguing that thousands of similar photos are available online—focused on the subject matter rather than the specific artistic presentation, and was therefore not valid (Antwerp, January 17, 2024, 2023/AR/147). We previously demonstrated just how heavy that burden of proof is for the author himself, based on A ruling on the originality of photographs.

For the Belgian trial court, the Court’s guidance is therefore useful. In the case of short social media posts, the comparison with “what everyone writes” is obvious, and it is precisely that comparison that the Court rejects. The correct question is whether the choice of words, the structure, and the tone of this specific text reveal the author’s choices. If so, then the text is a work, no matter how short or how mundane the subject may be.

Specifically, what does this mean?

For editorial staff and news sites. A social media post that goes viral is news, but the text remains the property of its author. Quote the passages that drive the story, summarize the rest, and link to the original. Repost a post in its entirety only if it is so short that an excerpt would be meaningless, or if the author gives permission; a 22-line post likely does not meet that threshold. Mention the author’s name and the source immediately, not after a complaint. If you’re unsure whether a planned article remains within the limits of Article XI.190 of the WER, that assessment is the first thing we’ll check for you.

For anyone who posts on social media. Your text is protected as soon as it reflects your own choices in word selection, structure, and tone. This applies to a column, but also to a well-written article consisting of just a few paragraphs. If your text is reproduced in its entirety without permission, you can demand its removal and compensation for damages, even if the party that reproduced it invokes the news exception. Save a screenshot showing the date and time of your original publication and of the reproduction. Anyone wishing to pursue such a dispute should seek the assistance of a attorney specializing in copyright law, because the burden of proof regarding originality rests with you.

Frequently asked questions (FAQ)

Is a Facebook post protected by copyright?

Yes, when the message reflects the author’s free and creative choices. On September 3, 2026, the Court of Justice confirmed that the length of the text, its publication on a social network, and its genre are irrelevant. A purely factual statement, such as an address or business hours, is not protected; however, a post with its own structure, tone, and choice of words is protected. The court assesses this on a case-by-case basis for each specific post.

Can the press reproduce content from social media without permission?

In Belgium, a journalist may reproduce short excerpts from a text in a report on a current event, provided that such use is justified for informational purposes and the source and author are cited. This is stipulated in Article XI.190, 1° of the Code of Economic Law. Reproducing the text in its entirety is not covered by this provision, unless the text is so short that an excerpt is not feasible.

Is a hyperlink to the original post sufficient as a source citation?

A hyperlink to the original post, including the author’s name, is a good way to cite the source. However, it does not replace the requirement that only short excerpts be reproduced: even with a link, reproducing the entire work constitutes a reproduction of the complete work. Furthermore, the link must be present at the time of publication, not only after a complaint has been filed.

My text was copied in its entirety by a news site. What can I do?

First, gather the evidence: a screenshot of your original post with the date, and of the copied content. Send the publisher a formal notice requesting that they remove the text or reduce it to an excerpt with proper attribution. If there is no response, you can file a cease-and-desist order and a claim for damages based on copyright law. You must, however, be able to demonstrate which creative choices make your text a work.

Conclusion

A 22-line Facebook post may constitute a copyrighted work, and a newspaper that reproduces it in its entirety generally cannot invoke the news exception when national law limits that exception to short excerpts. The Court of Justice thereby confirms the choice made by the Belgian legislature in Article XI.190, 1° of the WER, while at the same time rejecting any general prohibition on the press deriving commercial benefit from its reporting. In Belgium, therefore, the rule remains: quoting and linking are permitted, but copying is not.

ICT Rechtswijzer is the knowledge platform of the Intellectual Property, IT Law, AI Law, Data Protection, and Media Law department at Everest Advocaten, led by Joris Deene, Esq.
